The website is the exclusive property of Hine Moana, along with all associated rights. Any reproduction, in whole or in part, is subject to the prior authorization of Hine Moana. However, hyperlinks to the site are allowed without specific requests.
1. Acceptance of the Terms
The customer acknowledges having read, at the time of placing the order, the specific terms of sale outlined on this screen and expressly agrees to accept them without reservation.
These general terms and conditions of sale govern the contractual relationship between Hine Moana and its customer, with both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other conditions appearing in any other document, unless there is a prior, express, and written derogation.
2. Products
The photographs illustrating the products are not part of the contractual scope. If any errors have been introduced, Hine Moana cannot be held liable in any case. The majority of the products offered to customers by Hine Moana are available in our warehouse.
3. Order
Automatic recording systems are considered proof of the nature, content, and date of the order. Hine Moana confirms the acceptance of the order to the customer at the email address provided by the customer. The sale will only be concluded upon confirmation of the order. Hine Moana reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order. The information provided by the buyer during the order process is binding: in case of an error in the recipient’s contact details, the seller cannot be held responsible for any inability to deliver the product.
4. Delivery
Since July 1, 2021, shipments from overseas to mainland France are subject to VAT and customs duties. Customs procedures apply as they would for a shipment from a non-EU country. These fees are payable upon arrival by the customer and are not included in the original purchase price or shipping fees.
All orders placed with Hine Moana are intended for the personal use of customers. Customers and recipients of the products are prohibited from reselling the products, either in whole or in part. Hine Moana shall not be held liable for any legal consequences arising from the customer’s failure to pay any applicable taxes or duties.
Delivery will be carried out by postal services via tracked mail, registered mail, or Chronopost, depending on the shipping option selected by the customer. Any delivery delays or loss of a parcel by the postal carrier shall not entitle the buyer to claim compensation or damages from Hine Moana. In such cases, the customer must contact the postal carrier directly to obtain further information regarding the appropriate procedures.
4.1 Receipt of a Damaged Package
In case of visible defects, the buyer has the right to return the product under the conditions outlined in this document.
Force majeure events that relieve the seller of its delivery obligation include war, riots, fire, strikes, accidents, and the inability to obtain supplies. Goods always travel at the recipient’s own risk. Always check your package upon arrival. You have a 48-hour period to report any missing items or damage to the carrier.
5. Right of Withdrawal
You have 14 days from the receipt of the items to exercise your right of withdrawal. You may then exchange the product(s) purchased and received, or receive a store credit. Unless in specific cases, Hine Moana does not offer refunds.
The customer must include a withdrawal form with the returned package, written on a plain sheet of paper, or any other clear statement expressing their intention to withdraw:

It is recommended to return the package via tracked mail. In the event that the package is lost during shipping, Hine Moana cannot be held responsible.
6. Refund
In the case of an exchange or store credit, return the product(s) in their original packaging, intact, along with any accessories, user manuals, and documentation to the following address:

The shipping costs are the responsibility of the customer. The customer will receive a store credit within 15 days from the receipt of the returned product(s). In the specific case of a refund for an order made via PayPal, PayPal fees will not be refunded to the customer. The customer will only be refunded the amount received by Hine Moana.

In the case of non-receipt of the order within the delivery timeframe, due to non-shipment by the seller, or for any other reason not related to force majeure or the customer’s fault, the sale may be canceled at the customer’s written request, in accordance with the conditions outlined in articles L. 216-2 of the Consumer Code.
The amounts paid by the customer will then be refunded no later than fourteen (14) days from the date of contract cancellation by the customer. In the event of unavailability of the ordered product, the customer who opted for a refund will be refunded the amounts paid within fourteen (14) days of payment or will receive a store credit.
The refund will be made according to the payment method used by the customer when placing the order or in the form of a store credit.
7. After-Sales Service
Our jewelry is guaranteed for a period of one year from the date of purchase, covering the quality of the product: damaged or broken leather or pearls. The shipping costs are the responsibility of the customer.
8. Price
The price is expressed in euros.
The price indicated on the product pages does not include shipping.
The price indicated in the order confirmation is the final price, including all taxes, and includes VAT for France and EU countries. This price covers the product price, handling, packaging, and storage fees, as well as transportation and setup fees.
9. Payment
The price charged to the customer is the price indicated in the order confirmation sent by Hine Moana.
The price of the products is payable in full on the day of the actual order.
Payment is made by credit card bearing the CB logo.
E-transactions allows you to pay through a secure banking server.
Your credit card number is directed to the bank’s servers, and your payment is processed directly by the bank in a secure environment, without passing through the store’s server. This is particularly important because your card details are only known by our banking partner.
The order validated by the customer will only be considered effective once the relevant payment centers have approved the transaction. In case of refusal by these centers, the order will be automatically canceled, and the customer will be notified by email. Additionally, Hine Moana reserves the right to refuse any order from a customer with whom there is an outstanding dispute.
10. Disputes
This contract is governed by French law. Hine Moana cannot be held responsible for any damages, whether material, immaterial, or bodily, resulting from improper functioning or misuse of the products sold. The same applies to any modifications of the products made by the manufacturers. Hine Moana’s liability will, in any case, be limited to the amount of the order and cannot be invoked for simple errors or omissions that may have remained despite all precautions taken in the presentation of the products.
In the event of difficulties in applying this contract, the buyer has the option, before taking legal action, to seek an amicable solution, particularly with the help of:
– A professional association in the field
– A consumer association
– Or any other advisor of their choice
It is reminded that the search for an amicable solution does not interrupt the “short period” of the legal warranty or the duration of the contractual warranty. In general, and subject to the court’s assessment, compliance with the provisions of this contract concerning the contractual warranty assumes that the buyer honors their financial commitments to the seller.
Complaints or disputes will always be received with careful attention, with good faith being presumed from anyone who takes the time to present their situation. In case of a dispute, the client should first contact the company to find an amicable solution.
Failing that, the Commercial Court of Bordeaux will have exclusive jurisdiction, regardless of the delivery location or the accepted payment method.
11. Warranty
In all cases, Hine Moana cannot be held responsible for non-compliance with the regulatory and legal provisions in effect in the country of receipt, except for France.
Outside of France, Hine Moana’s liability is always limited to the value of the product in question, based on its sale date, with no recourse against the brand or the product manufacturing company.
In any case, the customer benefits from the legal warranty against eviction and hidden defects (Articles 1625 and following of the Civil Code). Provided that the buyer proves the hidden defect, the seller is legally required to repair all consequences (Articles 1641 and following of the Civil Code); if the buyer goes to court, they must do so within a “short period” from discovering the hidden defect (Article 1648 of the Civil Code).

12. Legal Information
Providing the personal information collected for the purpose of distance selling is mandatory, as this information is essential for processing and delivering orders, issuing invoices, and establishing warranty contracts. Failure to provide this information will result in the non-validation of the order.
In accordance with the “Data Protection and Privacy” law, the processing of personal information relating to customers has been declared to the [National Commission on Informatics and Liberty](w) (CNIL).
The customer has the right (Article 34 of the law of January 6, 1978) to access, modify, correct, and delete the data concerning them, which can be exercised with Hine Moana. Furthermore, Hine Moana commits not to share, free of charge or for a fee, the contact details of its customers with any third party.
